Terms of Use

1. Acceptance of Terms

By accessing getvibescan.com, submitting code for analysis, purchasing a scan, joining the waitlist, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy.

If you use the Service on behalf of a company or other organization, you represent and warrant that you have authority to bind that organization to these Terms, and "you" refers to that organization.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. The Service is not directed to, and may not be used by, anyone under 18. By using the Service you represent that you meet these requirements.

3. Description of the Service

VibeCheck provides an automated security analysis tool. You submit source code, and the Service returns a report that may identify potential security issues, severity ratings, exploit paths, and suggested fixes. The Service currently supports submitting up to ten source files per scan, subject to size limits shown on the site.

The analysis is generated by automated systems and large language models. VibeCheck may change, add, or remove features of the Service at any time.

4. No Guarantee of Security; Informational Purposes Only

THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL SECURITY REVIEW, PENETRATION TESTING, CODE AUDIT, OR LEGAL OR COMPLIANCE ADVICE.

Automated analysis is inherently limited. It may produce false positives, false negatives, or incomplete results. A report that shows few or no findings does not mean that your code is secure or free of vulnerabilities. VibeCheck does not warrant or guarantee that the Service will detect all vulnerabilities, weaknesses, errors, or security issues in any code you submit.

Reports may contain inaccurate severity ratings, incorrect or incomplete exploit paths, unsuitable remediation suggestions, and other errors. VibeCheck does not represent that any finding or suggested fix is correct, complete, or appropriate for your code, environment, or intended use. You must independently verify each finding and test every change before deployment.

You remain solely responsible for the security, testing, review, and deployment of your code and your applications. You agree not to rely on the Service as the sole basis for any security, deployment, compliance, or business decision. Any action you take based on a report is at your own risk.

5. Payment; All Sales Are Final; No Refunds

Certain features of the Service require payment. The price for a scan is displayed on getvibescan.com and is charged as a one-time payment processed by a third-party payment processor. You authorize us and our payment processor to charge your selected payment method for the amount shown, plus any applicable taxes.

ALL PURCHASES ARE FINAL. ALL SALES ARE FINAL AND NON-REFUNDABLE. WE DO NOT OFFER REFUNDS, CREDITS, OR EXCHANGES FOR ANY REASON, INCLUDING BUT NOT LIMITED TO DISSATISFACTION WITH THE RESULTS, AN UNUSED SCAN, A REPORT THAT DOES NOT MEET YOUR EXPECTATIONS, OR A CHANGE OF MIND.

Because the Service delivers a digital result immediately upon use, you acknowledge and agree that, to the maximum extent permitted by applicable law, you waive any right to a refund or to cancel the purchase once payment is made. You are responsible for all taxes associated with your purchase, other than taxes based on our net income.

6. Your Content and Code

You retain all ownership rights in the code, files, and content you submit to the Service ("Your Content"). We do not claim ownership of Your Content.

By submitting Your Content, you grant VibeCheck a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and analyze Your Content solely for the purpose of generating your report and operating and improving the Service. This license ends when processing of your scan is complete, except as needed to comply with law.

You represent and warrant that you own Your Content or have all rights and permissions necessary to submit it for analysis, and that submitting it does not violate any law, contract, or third-party right. You must not submit code, credentials, or data that you are not authorized to disclose or analyze.

7. Processing by Third Parties

To generate your report, Your Content is transmitted to and processed by third-party artificial intelligence providers and infrastructure providers. VibeCheck does not permanently store Your Content or your report. Our Privacy Policy describes how information is handled and which categories of providers are involved.

8. Acceptable Use

You agree not to do any of the following:

• Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
• Submit code, credentials, or data that you do not have the right to submit or analyze.
• Attempt to reverse engineer, decompile, extract, or discover the underlying prompts, models, detection methodology, or source code of the Service.
• Probe, scan, or test the vulnerability of the Service, or breach or circumvent any security, authentication, rate-limiting, or bot-protection measure.
• Use automated means to access the Service in a way that exceeds reasonable use or that circumvents usage limits.
• Resell, sublicense, rent, or commercially exploit the Service without our prior written permission.
• Use the Service to create, test, refine, or distribute malware or other malicious code.
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.

9. Intellectual Property

The Service, including the VibeScan analysis engine, the VibeCheck and VibeScan names and logos, the detection methodology, prompts, models, software, text, graphics, and design, is owned by VibeCheck or its licensors and is protected by intellectual property and other laws.

Except for the limited right to use the Service in accordance with these Terms, no license or right is granted to you, whether by implication, estoppel, or otherwise. You may not copy, modify, distribute, or create derivative works of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

VIBECHECK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT IT WILL DETECT ALL VULNERABILITIES OR MEET YOUR REQUIREMENTS. ANY MATERIAL OBTAINED THROUGH THE SERVICE IS ACCESSED AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL VIBECHECK OR ITS OWNERS, OPERATORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANY SECURITY BREACH OR VULNERABILITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF VIBECHECK FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO VIBECHECK IN THE THIRTY DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR TEN UNITED STATES DOLLARS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIBECHECK IS NOT RESPONSIBLE FOR CODE CHANGES, DEPLOYMENTS, SECURITY INCIDENTS, DATA LOSS, SERVICE INTERRUPTION, OR OTHER CONSEQUENCES RESULTING FROM YOUR RELIANCE ON A REPORT OR SUGGESTED FIX.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In that case, our liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless VibeCheck and its owners, operators, and employees from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys fees, arising out of or related to your use of the Service, Your Content, or your violation of these Terms or of any law or third-party right.

13. Third-Party Services

The Service relies on third-party services, including payment processing, artificial intelligence analysis, hosting, bot protection, and email delivery. Your use of those services may be subject to their own terms and privacy practices. VibeCheck is not responsible for, and makes no warranties regarding, third-party services.

14. Modifications to the Service and These Terms

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We may also update these Terms from time to time. When we do, we will post the updated version on this page.

Your continued use of the Service after updated Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination, including sections 4 through 13 and 16, will survive.

16. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Texas, without regard to its conflict of laws rules.

You agree that any dispute that is not subject to informal resolution will be brought exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction and venue of those courts.

17. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

These Terms, together with the Privacy Policy, are the entire agreement between you and VibeCheck regarding the Service and supersede any prior agreements. You may not assign these Terms without our consent; we may assign them freely.
